About these terms

These terms of use set out the basis on which you may use this website. By using the site you accept them. If you do not accept them, please do not use the site.

This is a marketing and information website. It is not the contract under which the Continuum platform is licensed or supplied. If your organisation buys Continuum, a separate written agreement governs that, and where the two documents conflict, the signed agreement wins.

Who we are

This site is operated by Terrafa Limited, a company registered in England and Wales under company number 16997385.

We are a business-to-business supplier. This site is directed at organisations and at people acting in a professional capacity, not at consumers.

Acceptance and changes

We may amend these terms at any time by changing this page. The version and date at the top show when the current text took effect. Check this page when you return to the site; continuing to use it after a change means you accept the amended terms.

We may also change, suspend or withdraw the content of the site without notice.

Access to the site

Access is provided free of charge and on a temporary basis. We do not guarantee that the site, or any of its content, will always be available, uninterrupted or error-free. We may suspend, withdraw or restrict all or part of it for business or operational reasons.

You are responsible for arranging your own access, and for making sure that anyone who uses the site through your connection knows and follows these terms.

How you may use the site

You may view, download and print pages from this site for your organisation's internal evaluation of Terrafa and its products. That permission is what the site is for.

You must not:

• republish, redistribute or commercially exploit any part of the site, or present its content as your own;
• remove or alter any copyright, trade mark or other proprietary notice;
• use the site or its content to build, train, benchmark or market a competing product or service;
• use any automated system to scrape, harvest or systematically extract content, or place unreasonable load on the infrastructure serving it;
• attempt to gain unauthorised access to the site, its origin storage, its distribution infrastructure or any connected system;
• introduce any material that is malicious or technologically harmful, or attack the site by denial-of-service or any similar means;
• use the site for any unlawful or fraudulent purpose, or in breach of any applicable law.

A breach of this section may be a criminal offence under the Computer Misuse Act 1990. We will report a serious breach to the relevant authorities and cooperate with them, including by disclosing your identity where we lawfully can.

You agree to compensate us for any loss, damage, cost or expense we incur as a result of your breach of these terms.

Intellectual property

We own or are licensed to use all intellectual property rights in this site and in everything published on it. Those works are protected by copyright, database right and trade mark law around the world. All such rights are reserved.

"Terrafa" and "Continuum", the Terrafa logo, and the presentation of the site are marks and material belonging to Terrafa Limited. Nothing on this site grants you any licence to them beyond the limited permission in section 5.

You must not use any illustration, diagram, photograph, or the descriptive material about the platform separately from the text it accompanies.

No reliance on this content

The content of this site is provided for general information. It describes what Continuum is designed to do and the problems it is built to address. It is not advice — technical, operational, commercial, financial or legal — and you should not act on it without your own assessment.

Nothing on this site is an offer capable of acceptance, a quotation, or a commitment to supply. Descriptions of capability, deployment timelines, pricing structure and results are indicative. What Terrafa actually commits to is what appears in a signed agreement, against acceptance criteria agreed in writing.

We take care over the accuracy of what we publish, but we make no representation or warranty, express or implied, that the content is accurate, complete or current.

Forward-looking statements

Parts of this site describe our intentions and expectations for the platform — capability under development, planned integrations, and the direction of the product. Those statements reflect our view at the date of publication.

They are not commitments, and they are subject to change. Do not make a purchasing decision on the basis of functionality that has not been demonstrated to you or written into a contract.

Preview and confidential material

Parts of this site may be shared with you as a preview, ahead of general publication, at a link that is not indexed by search engines and not publicly advertised.

If a preview link has been given to you, or to your organisation, treat it as shared in confidence: use it for your own evaluation, share it only with colleagues who need it for that purpose, and do not post it publicly or pass it to a third party without asking us. Anyone who has the link can open the page — there is no password on it — which is precisely why we ask you to handle it with care.

Where a separate non-disclosure agreement is in place between us, that agreement governs, and this section does not cut it down.

Links to other sites

Where this site links to other sites or resources provided by third parties, those links are for information only. We do not control them, do not endorse them, and accept no responsibility for their content or for any loss arising from your use of them.

You may link to our home page, provided you do so fairly and lawfully, in a way that does not damage our reputation or suggest an association, approval or endorsement that does not exist. You must not frame the site on any other site. We may withdraw permission to link at any time.

Privacy

Our Privacy Policy explains how we handle personal data. It forms part of these terms. Our Security overview describes how we protect information entrusted to us.

This site sets no cookies and runs no analytics. The Privacy Policy sets out the one third-party request the page makes, and what that discloses.

Our liability

Nothing in these terms excludes or limits our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.

To the extent permitted by law, we exclude all conditions, warranties, representations and other terms that might otherwise be implied into your use of this site.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising out of or in connection with:

• use of, or inability to use, this site; or
• use of or reliance on any content displayed on it.

In particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss.

We are not liable for loss or damage caused by a virus or other technologically harmful material that infects your equipment through your use of this site or of anything you download from it. You should use your own virus protection.

These exclusions apply to this website. Our liability under any agreement to supply Continuum is set out in that agreement, and is not affected by this section.

Suspending access

We may withdraw your access to this site, or to a preview link, immediately and without notice if we reasonably believe you have breached these terms. We may take any other action we consider appropriate, including legal proceedings and disclosure to law enforcement.

General

If any provision of these terms is found to be unlawful or unenforceable, the rest remains in force.

If we delay in enforcing a term, or do not enforce it, that is not a waiver of our right to enforce it later.

Nobody other than you and Terrafa Limited has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.

Governing law

These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute or claim arising out of or in connection with them.
